Competition Terms and Conditions(Required) Entrants must: 1. Fill out the entry form, providing the following: - Provide a valid email address - Provide a PDF, JPEG, MP3, MP4 or other valid file types of a creative artwork (in any form) inspired by a visit to a National Trust of Australia (Victoria) Place. (https://www.nationaltrust.org.au/places-vic/) - Provide an image to attach to your entry for display on the National Trust website - Provide a short description of your artwork - Agree to your artwork and associated image being shared in the online gallery 2. Accept the following competition terms and conditions, confirming that they have read and understood the terms and conditions. Terms & Conditions: The “National Trust” means the National Trust of Australia (Victoria). Following lodgement of the competition entry, the National Trust will assess the entry and determine whether your artwork will be displayed in the online gallery. The National Trust reserves the right, in its sole discretion and without liability, to reject any lodgement or suspend or remove any competition entry that does not comply with these Terms and Conditions, or if it considers that it may bring the National Trust into disrepute, even after the competition entry is lodged and accepted. Except as otherwise agreed expressly in writing and advised to you by the National Trust, you must arrange and pay all costs whatsoever associated with your artwork. The logos, branding, artwork and all information, materials and other property displayed by the National Trust (including all intellectual property, which for the avoidance of doubt includes all copyrights, trademarks, domain names and rights protecting goodwill and reputation, whether registered or unregistered, and all application for the same, anywhere in the world) remain the exclusive property of the National Trust. Acceptance of your competition entry does not provide the right to use National Trust branding. No responsibility is taken for competition entries that are lost, delayed, misdirected or incomplete or cannot be submitted for any technical or other reason. You agree you have the necessary permission to publish and promote the submitted artwork and promotional images and you also confirm you have the necessary permission from people who may appear in the photograph and that you do not infringe upon their copyrights, trademarks, contract rights, or any other intellectual property rights of any third person or entity, or violate any person’s rights of privacy or publicity. You also agree to pay the cost of any fees or fines incurred by the National Trusts due to breach of image copyright or privacy associated with images supplied by you. By entering the Heritage Futures Creative Artwork Competition and supplying images/films/artworks/text you agree that these may be used by the National Trust for the purpose of the Heritage Futures Creative Artwork Competition and the Heritage Futures Program 2026. You also grant to the National Trust a non-exclusive, non-transferable and royalty free license to use these materials for 5 years following the date of registration for archival purposes by the National Trust. The Heritage Futures Creative Artwork Competition reserves the right to refuse to promote any competition entry or to remove the digital gallery display where there is any conflict with sponsorship agreements signed by the National Trust. The National Trust assumes no responsibility for any incorrect, inaccurate or incomplete information, whether caused by website users or by any of the equipment, programming and promotion associated with or utilised in the Heritage Futures Creative Artwork Competition. All competition entries must comply with all laws, including but not limited to, Copyright and Occupational Health and Safety laws. You consent to the personal information in the lodgement and entry of your artwork being recorded and used by the National Trust for the purpose of informing you about other services, events and other heritage related activities that are organised or promoted by the National Trust. Notwithstanding the above consent, all personal information collected by the National Trust will only be used for the purpose for which it was provided and in accordance with the Privacy Act 1988 (Cth). All competition entries are subject to the laws of Australia. All indemnities survive termination of any relationship with you. All terms and conditions are binding on you and all of your representatives and may be subject to change without notice. If you wish to withdraw from your participation in the Heritage Futures Creative Artwork Competition, written notice must be given to the National Trust. If any publication deadlines have passed, the entry cannot be withdrawn from these publications. You agree you will not represent you have any affiliation with the National Trust other than that you have entered the Heritage Futures Creative Artwork Competition. Conditions of entry This competition is an initiative of National Trust of Australia (Victoria). Entry into the competition means you accept these terms and conditions. Entry into the competition is free. Employees of National Trust of Australia (Victoria), and their immediate families, are not eligible to enter. The judges' decision is final and no correspondence will be entered into. One (1) winner will be notified. No responsibility is accepted for any variation in the value of the prize. No responsibility is accepted for late, lost or misdirected entries. Any personal information entrants provide will be treated as confidential and managed in accordance with the National Trust of Australia (Victoria) Privacy Policy. (https://www.nationaltrust.org.au/privacy-policy/) National Trust of Australia (Victoria) reserves the right to modify these terms and conditions at any time without notice. National Trust of Australia (Victoria) may disqualify you if: i. you or your Entry do not meet any one or more of the requirements set out in these Terms and Conditions; ii. you tamper in any way with the operation of the Competition. Dates The competition commences on 10 May 2026 at 9am AEST. Entries close on 3 December 2026 at 4pm AEDT. Prize draw and notification The Competition is a game of chance. Skill plays no part in determining the winner and the winner will be selected at random. National Trust of Australia (Victoria) will appoint judges for the Competition (the 'Judges'). The prize Selection Date will be 3 December 2026 at 4pm. Members of the Education and Public Programs branch of National Trust of Australia (Victoria) will draw the winner at random on the Selection Date. The draw is conducted using an online random number generator, and may be drawn at National Trust of Australia (Victoria) premises or remotely. The Judges will select from all valid Entries into the Competition, one prize will be awarded. The Judges' decisions are final and no correspondence will be entered into. The Winner(s) will be notified by email on the selection date. All reasonable attempts will be made to contact the Winner(s). If, despite reasonable efforts by National Trust of Australia (Victoria) a potential prize winner does not respond to National Trust of Australia (Victoria) by 22 December 2026, 11.59pm AEDT, the prize(s) will be forfeited, and National Trust of Australia (Victoria) reserves the right to select a new winner. The Winner(s) will need to provide an email address for National Trust of Australia (Victoria) to send the prize. If any proposed selection date falls on a public holiday in Victoria, that selection will be conducted on the following business day. Prize The prize is not transferable or exchangeable and cannot be taken as cash. The prize consists of a three (3) year household membership to the National Trust of Australia (Victoria), valued at up to $315. If a National Trust membership is already owned by the winner, a three (3) year extension on their membership will be awarded. The maximum total prize pool value will not exceed $1,000.00 AUD. The Major Prize(s) is subject to the terms and conditions as imposed by the provider of the prize, including period of validity and expiry, or any booking or redemption time frames. If the prize is unavailable, for whatever reason, National Trust of Australia (Victoria) reserves the right to substitute the prize for a prize of equal or greater value, subject to law. You may not ask for any alternative Prize (including cash). If you are not able to take the Prize as stated, you will forfeit the Prize and no payment or compensation will be made in lieu. National Trust of Australia (Victoria) may ask you or your parent/legal guardian to provide proof of your age, identity and residency, and to sign any required documentation including release forms as a condition of claiming the Prize. You or your parent/legal guardian are responsible for all expenses and taxes connected to your participation in the Competition and not included in the Prize. Other Terms National Trust of Australia (Victoria) and agencies or companies associated with this Promotion will not be liable for any loss or damage whatsoever which is suffered (including indirect or consequential loss) or for any personal injury suffered or sustained in connection with a prize except for any liability which cannot be excluded by law. National Trust of Australia (Victoria) and their associated agencies and companies is not liable for (including any costs) any error, omission, interruption, deletion, defect, delay in operation or transmission, network failures, tampering, unauthorised intervention, fraud communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and any cause beyond the control of National Trust of Australia (Victoria), and reserves the right to take any action that may be available. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders National Trust of Australia (Victoria)’s ability to properly proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, computer virus, fraud, tampering, unauthorised intervention, or technical failure, National Trust of Australia (Victoria) may in its absolute discretion cancel, terminate, modify or suspend the competition, subject to direction of the relevant authorities. The Competition and Consumer Act 2010 (Cth) as well as other laws in Australia may imply certain conditions, warranties and undertakings, and give you other legal rights. If they apply, they cannot be modified or excluded by any contract. You may consider seeking legal advice as to whether they apply to you. Nothing in these Terms and Conditions generally affects your rights under Australian consumer law (as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) and equivalent State and Territory fair trading legislation) regarding consumer guarantees to the extent that such consumer guarantees cannot be excluded by law. Other than these consumer guarantees National Trust of Australia (Victoria) makes no warranties about any prizes offered as a part of the Competition, including warranties as to the quality, merchantability or fitness for purpose of such prizes. You agree to indemnify National Trust of Australia (Victoria) against all liabilities suffered or sustained by National Trust of Australia (Victoria) arising from any claim by a third party that your Entry infringes the rights (including intellectual property rights) of any third party. Severability Any provision (or part thereof) of these Terms and Conditions that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. That does not invalidate the remaining provisions (or parts thereof) of these Terms and Conditions nor affect the validity or enforceability of that provision (or part thereof) in any other jurisdiction. Entire Agreement These Terms and Conditions contain the entire agreement between you and National Trust of Australia (Victoria) with respect to the Competition. They set out the only conduct that you have relied on and supersede all earlier conduct and prior agreements and understandings between you and National Trust of Australia (Victoria) in connection with the Competition.
