1. For the purposes of these Terms and Conditions, “The Promoter” refers to National Trust of Australia (Victoria) whose Instagram handle is @nationaltrustvic. The “Prize” refers to the $200 NTV Gift Card and eDM Feature.
  2. The Competition commences at 12:01am AEST on Saturday 5 August 2023 and ends at 11:59pm AEDT on Sunday 15 October 2023. (“Competition Period”) Entries received outside of the Competition Period will not be accepted by the Promoter and will be deemed to be invalid. 
  3. The winner will be drawn and notified on Monday 16 October 2023 via Instagram direct message. If the winner doesn’t respond within 48 hours, National Trust of Australia (Victoria) will proceed to choose a second winner.
  4. The Promotors competitions with entry via Instagram are open only to residents of Australia. One (1) winner will be chosen at by the NTV. 
  5. No purchase necessary. Winners will not be required to pay to enter the competition.
  6. Entrants must be over 18 years old on the date of their entry.
  7. Employees of The Promoter are not eligible to enter.
  8. The Competition is in no way sponsored, endorsed or administered by, or associated with, Instagram.
  9. Each entrant can enter the competition as many times as they wish to.
  10. Each entrant shall enter the competition via Instagram by uploading an image of the Flora found within Como House and the surrounding Como Gardens. Images can be of the florals found on Como’s furnishings, decorative arts, textiles and – of course – the gardens. Entrants must then tag @nationaltrustvic and #FindingFloraNT for their entry to count.  
  11. Entrants must only capture images on a phone camera.  
  12. By entering this Competition each Entrant warrants to the Promoter that their submitted Entry is an original work of the Entrant, has not been previously published or won any award and does not contain any material which would infringe the rights of any third party, including any copyright, trademark or other third party intellectual property rights. The Entrant agrees to indemnify the Promoter and keep the Promoter indemnified against all claims and costs incurred by third parties arising from a breach of the warranties set out in this clause. 
  13. Each Entrant assigns all proprietary rights (including any intellectual property rights) they have in their Entry to the Promoter. Each Entrant acknowledges and agrees that their Entry becomes the property of the Promoter and the Promoter has the right to alter the design and use the Entry across any communication or marketing platform owned or used by the Promoter. The Promoter is entitled to use any of the submitted Entries for any purpose, including (but not limited to) any future promotion, marketing or publicity purposes. 
  14. The competition will be a game of skill where National Trust of Australia (Victoria) will decide on their favourite floral photo.
  15. The Promoter will not be held liable for any failure of receipt of entries. The Promoter takes no responsibility for any entries which are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid.
  16. To the extent permitted by applicable law, The Promoter’s liability under or in connection with the competition or these terms and conditions shall be limited to the cost price of the Prize in question.
  17. To the extent permitted by applicable law, The Promoter shall not be liable under or in connection with these terms and conditions, the competition or any Prize for any indirect, special or consequential cost, expense, loss or damage suffered by a participant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and the promoter and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.
  18. Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available. Where a Prize becomes unavailable for any reason, the promoter reserves the right to substitute that prize for a prize of equal or higher value.
  19. The name, address, email address and phone number of the winner must be provided to The Promoter if requested and will be shared to enable fulfilment of the Prize. 
  20. In the event of unforeseen circumstances beyond The Promoter’s reasonable control, the promoter reserves the right to cancel, terminate, modify or suspend the competition or these terms and conditions, either in whole or in part, with or without notice.
  21. The Promoter’s decision is final. No correspondence will be entered into.
  22. The winner’s name, social media username and winning photo may be posted on the social media profiles of The Promotor after the winner has been selected.
